Real Life Photo Sweepstakes
Official Rules
NO PURCHASE NECESSARY. PURCHASE WILL NOT ENHANCE CHANCES OF WINNING.
1. Sponsor: ABC, Inc. dba Walt Disney Studios Motion Pictures, 500 South Buena Vista Street, Burbank, CA 91521.
2. Administrator: Big Honcho Media, LLC, 111 Broadway, 5th Floor, New York, NY 10006.
3. Eligibility: To be eligible for one of the prizes, entrants must be, at the time of entry: (a) a natural person who is a legal resident of, and currently living in, the 50 United States or the
District of Columbia; and (2) 18 years of age or older (and not a minor in his or her state
of residence); and must not be an employee or director, or IRS dependent, immediate family member or individual residing in the same household of, an employee or director, of Sponsor, Administrator or of any participating website, or their respective subsidiaries and affiliated companies, advertising, promotion, or production agencies, web masters and web suppliers. Void where prohibited. By participating, all entrants agree to be bound by these Official Rules (“Official Rules”).
4. To Enter: The “Real Life Photo Sweepstakes” consists of separate sweepstakes (individually and collectively, as applicable, the “Sweepstakes”) on various participating websites, each Website providing an opportunity to win prizes. To enter this Sweepstakes for the opportunity to win a prize, go to one of these websites: www.film.com, www.teenspot.com, www.soundtrack.net, www.teenscenemag.com, www.sheknows.com, www.artistdirect.com, www.myjellybean.com, www.acedmagazine.com, www.alloy.com, www.popmatters.com, www.parenthood.com, www.iesb.net (individually “Website”, collectively “Websites”). Then, complete an entry form and upload one (1) of your favorite photographs of your family, per entry, during the sweepstakes entry period (“Sweepstakes Entry Period”). You may enter the Sweepstakes up to five (5) times per Website, but each entry must contain a separate photograph in compliance with Section 5 below. However, you may enter the same five (5) photographs on all the Websites. Duplicate photographs submitted on any single Website will be disqualified. Your entry(s) on one or more Websites will accrue your chances of winning a prize (the prizes are the same on all Websites), but you may only win one (1) prize per person/family/household for the entire Sweepstakes (all Websites combined.) Entrant may use only one email address (“Address”) to enter and must use the same Address to enter all of the Sweepstakes on all of the Websites. No modifications or changes in the Address will be permitted by Sponsor and Sponsor will only permit or use the Address submitted by Entrant at the time of entry. Entrants may not use any other means to enter multiple times, and any entrant who does so, or otherwise attempts to enter multiple times will be disqualified. Any attempt at e-mail entry is also void.
5. Sweepstakes Entry Period: The Sweepstakes Entry Period commences at 12:00 a.m. Eastern Time on September 21, 2007 and ends at 11:59 p.m. Eastern Time on November 2, 2007. Administrator’s computer will be the official clock for the Sweepstakes. Normal Internet access and usage charges imposed by your on-line service will apply.
6. Photograph Submission Requirements: Each photograph submitted by an entrant is subject to all provisions of the Website’s Terms of Use (“Terms of Use”), including, but not limited to, terms and conditions related to the use of submitted photographs and other User-Generated Content. For a copy of the Website’s Terms of Use, please click on the “Terms of Use” link on the Website(s) or visit http://disney.go.com/corporate/legal/terms.html. Only photographs that are in compliance with the Terms of Use, as determined solely by Sponsor, will be eligible for entry in the Sweepstakes. Each photograph must be in a .jpg or .tiff file format only, not to exceed 640 pixels (we recommend 72 dpi). No more than five (5), separate photographs may be submitted by Entrant per Website during the Sweepstakes Entry Period. Each photograph entered must be a different photograph. Entries submitting a photograph duplicative of a previous entry will be disqualified. Per the Terms of Use, you may not upload any photographs for which you do not have the consent of every person appearing in the photograph as well as the photographer of the photograph. Please read the Terms of Use carefully as other restrictions apply.
7. Random Drawing: Winners will be selected, in random drawings to be held on or about November 5, 2007, unless time frame is changed by Sponsor in its sole discretion, from among all eligible entries received by each Website. Sponsor’s decisions are final and binding in all matters relating to this Sweepstakes. Odds of winning depend on the number of eligible entries received on each Website on which Entrant enters. The potential Grand Prize Winner will be notified by e-mail on or after November 12, 2007 before 7:00 P.M, and the Second Prize Winners will be notified by e-mail on or after November 12, 2007 before 7:00 P.M.
8. Prizes:
Grand Prizes – One (1) Grand Prize per Website consisting of one (1) digital camera and one (1) photo printer. Approximate Retail Value of Grand Prize: $250. Sponsor reserves the right to substitute prize, or any part thereof, with a prize of equal or greater value.
Second Prizes – Five (5) Second Prizes per Website, each consisting of one (1) one-sheet poster and one (1) soundtrack album from the movie “Dan in Real Life”. Approximate Retail Value of Each Second Prize: $25. Sponsor reserves the right to substitute prize, or any part thereof, with a prize of equal or greater value.
Total approximate retail value of all Prizes per Sweepstakes: $275
Limit one (1) Prize per person/family/household regardless of the number of Sweepstakes entered.
9. Limitations on Liability: Entrants agree that Sponsor, Administrator, the Websites and their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively "Released Parties") will have no liability whatsoever, and shall be held harmless by entrants, for any injuries, claims, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Sweepstakes, or entrant’s failure to comply with the Official Rules. The Released Parties shall not be liable to any winner or any other person for failure to supply any prize(s) or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Released Parties’ control. The Released Parties are not responsible for illegible, lost, late, damaged, incomplete, misdirected, or stolen entries; or for lost, interrupted or unavailable network, server, satellite, Internet Service Provider (ISP), website or other connections, availability or accessibility; or for miscommunications, failed computer, telephone or cable transmissions, lines, or technical failure; or jumbled, corrupted, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties; or for any other errors of any kind whether human, mechanical, electronic, technical or network; or for the incorrect or inaccurate capture of entry or other information or the failure to capture any such information; or for any misdirection or delay of any e-mail to be received on account of technical problems or traffic congestion on the Internet or on the Websites, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading or uploading any materials from the Sweepstakes; or for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes.
10. General Conditions: Persons who tamper with or abuse any aspect of the Sweepstakes or Websites, as solely determined by the Sponsor, will be disqualified, and Sponsor reserves the right to terminate such entrant's eligibility. Should any portion of the Sweepstakes be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes, and select winner from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. In the event of a dispute regarding prize claims or entries received from multiple users having the same Address, the authorized subscriber of the Address at the time of entry used to enter, and not the name on the entry form, will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the Address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. Any use of micro, automatic, programmed, robotic, or like entry methods will void all such entries by such methods, and entrants using such methods will be disqualified.
Except where legally prohibited, winners grant (and agree to confirm that grant in writing) permission for the Released Parties and those acting under their authority to use his/her name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes without additional compensation in all media now known or hereafter discovered, worldwide, including, without limitation, on the World Wide Web, without notice, review or approval.
If any prize notification or prize is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these Official Rules or the Terms of Use, such prize will be forfeited and an alternate winner selected. Noncompliance with any of the foregoing may result in disqualification and awarding of prize to an alternate winner. Federal, state and local taxes and all other expenses not specified herein are winner's sole responsibility.
As a condition to receiving a prize, the potential winners will be required to sign and return to the Sponsor within the time specified by Sponsor: (1) proof of age, identity and residency an affidavit of eligibility/liability and publicity release/prize acceptance (where legally permissible); (3) an assignment of rights, if required; and (4) any such other documentation as the Sponsor may require in its sole discretion. Any potential winner, who does not execute and return all such documentation within the required time frame, will forfeit their prize and the Sponsor may select another potential prize winner.
The Sponsor may assign all rights granted by you hereunder to any party at the Sponsor’s sole discretion.
All issues concerning the construction, validity, interpretation and enforceability of these Official Rules, and the rights and obligations of the entrants, shall be determined by the Sponsor and Administrator in their sole discretion and governed by California law without regard to any conflict of laws principles.
11. Privacy: The registration information you provide will be used to administer this Sweepstakes. In accordance with the terms of our Privacy Policy, we also use this information to provide you with a more personalized experience, including future recommendations and promotions that may be of special interest to you. 12. Official Rules and Winners List: For an additional copy of these Official Rules or the names of the Winners, send a self-addressed stamped envelope to: Big Honcho Media, Attn: Dan in Real Life Sweepstakes, 111 Broadway, 5th Floor, New York, NY 10006. Requests received after November 30, 2007 will not be honored. This Sweepstakes shall be governed by the laws of the state of California in the United States of America and is subject to all applicable federal, state and local laws. Void where prohibited by law.
